Can you be charged with possession of marijuana if its not found on you ?
Let's say you threw it out somewhere and weeks later someone saw you doing that on a security camera recording. Can you be arrested based on the footage or do you actually have to be in possession of it to be charged ?
As much as appreciate everyone attempting to give the best possible answer I am hoping for someone that knows rather than guessing at the answer. It would be impossible to know if what you threw out was actually an illegal substance. If you don't admit to anything, the prosecution will have a hard time proving their case against you. I can't believe a judge would even let it go forward without any evidence.
